The Irish media regulator, the Coimisiun na Mean, recently announced an investigation into two major social media platforms, TikTok and LinkedIn. This initiative aims to examine the compliance of these companies with the European regulation on digital services (DSA), particularly regarding the reporting of illegal content. Authorities suspect that the reporting mechanisms in place are not accessible and may discourage users from reporting inappropriate content.
Reasons for the Investigation
The investigation by the Coimisiun na Mean, announced on December 2, focuses on concerns related to the user-friendliness of the reporting mechanisms for illegal content on TikTok and LinkedIn. John Evans, head of digital services at this commission, emphasized that these interfaces could discourage users from making reports, which goes against the requirements stipulated by the DSA.
The European regulation aims to enhance online safety, particularly regarding dangerous content such as child pornography. The absence of means for users to report such content anonymously is a direct violation of the current legal framework, raising questions from Irish authorities.
Legal Context and Responsibility of Platforms
In the context of the DSA, the European Commission plays a central role as the main regulatory authority for large digital companies. However, the practical enforcement of these regulations also relies on national regulators, who ensure their implementation within their jurisdiction. For TikTok and LinkedIn, it is Ireland that is supposed to oversee their compliance, highlighting the importance of this investigation.
The results of the investigation could have significant consequences, with the possibility of imposing fines of up to 6% of the revenue of these companies if they are found guilty of violations. In response to the opening of this investigation, a spokesperson for TikTok stated that the company is committed to ensuring the safety of its platform and upholding its legal obligations. They promised to cooperate with the Coimisiun na Mean to improve their reporting methods.
For its part, LinkedIn also reacted, claiming to have “effective mechanisms” in place to allow users to report potentially illegal content. However, these statements will undergo scrutiny and will likely be closely examined by regulators.
